An older couple drove their car into my mailbox. The mailbox & post was destroyed. How do I get them to pay?

The lady doesn’t want to go through her car insurance & she thinks we should go 50/50. My husband & I say no way to 50/50, our mailbox was perfectly fine & there was no reason to purchase a new one. That one was only 3 1/2yrs old. Money is tight, am sure everyone would agree. We have been more then patience with the couple, however or patience has run out.

I agree with small claims court. But your situation reminds me of something that happened to me about 20 years ago.

One evening our next door neighbor came home drunk with his car all bashed up on the right side, and correspondingling, all the mailboxes on the street where mowed down. The next week, our across the street neighbor (drunk also) pushed the gas instead of the brake and mowed down our newly reinstalled mailbox. A couple of weeks later and and whole bunch of new mailboxes later too, my own car parked in the driveway all of a sudden slid down the driveway across the street and mowed down the across the street drunken neighbor’s mailbox. And they say there’s no such thing as coincidence. Ha ha. Anyway we all had some good belly laughs and thanked God it was just mailboxes and no people were hit.

    Contact her insurance company. You may have to file a report with the police, if you haven’t already (some insurance companies require it).

    They should pay for all of it! How rude is that! They’ll probably use the ‘im old and broke’ line on you. I think that you’re well within your rights to expect them to pay for the full repair/replacement and I don’t think you’re being unreasonable at all.

    Call your insurance company for your homeowner’s policy and they will give you some advice. It can be gone about two ways – one way is to file a claim with your home owner’s policy and they will abrogate it to the insurance company of the couple who took out your mailbox. The easier way is probably to contact their insurance company directly. The decision to avoid an insurance company is YOURS. If they give you trouble and don’t pay in full, you have no choice but to go through insurance co.

    You might want to check filing in a small claims court. If you win they would have to pay court fees as well.

    Make sure you have photos and get a police report if you don’t have one already.

    50/50? Tell them they left the scene of a accident and you are going to report them. You have to tell the fading generations over and over again for them to listen, they have dated ways and fear then the youth.

    You have to watch out for you. There’s already a disagreement the police should have been called, what if you have to go through the insurance company. That is if they are insured.I bet t there’s been a change in attitude
